COLUMBIA, Mo. (AP) — A former northwest Missouri prosecutor who boycotted grand jury proceedings rather than file charges against a Chillicothe murder suspect was scheduled to testify Wednesday as part of a new appeal.

Doug Roberts was the top prosecutor in Livingston County when teenager Mark Woodworth was suspected of the 1990 shooting death of his neighbor Cathy Robertson. A Livingston County judge summoned special prosecutors from the state Attorney General’s Office when Roberts declined to seek Woodworth’s indictment.

Woodworth was indicted by that grand jury in 1993, convicted two years later, briefly released after a successful appeal and again convicted in 1999. He is serving a life sentence.

A hearing on whether Woodworth deserves a new trial is taking place this week in Boone County Circuit Court.
