A judge has appointed an assistant Missouri attorney general to serve as a special prosecutor in the case against a Columbia man.  Boone County Prosecutor Dan Knight said Friday that he had a conflict of interest in Ryan Ferguson’s case.

Ferguson was convicted of murder and robbery in the 2001 killing of Columbia Daily Tribune sports editor, Kent Heithold.  An appeals court ruled Tuesday that the prosecution had wrongly withheld evidence from the defense and said Ferguson did not receive a fair trial.

Knight said his office had a conflict of interest due to the actions of an investigator for the prosecutor’s office, according to court documents filed on Friday. Assistant Attorney General Susan Boresi will now serve as a special prosecutor as the state considers whether to re-try Ferguson.
