An Odessa man will make a court appearance this morning, following a judge’s decision last week to grant a continuance for his jury trial. Joseph Courtway II, 46, was charged with second degree murder following the death of his uncle,  Paul Schwartze,56, in October of 2012.

The two men were reportedly arguing over hunting privileges when the argument turned physical. Schwartze sustained fractures around his eye and later died from his injuries.

Courtway’s 3-day-trial was originally schedule to begin on Wednesday. According to online court records, he will now be arraigned in a Lafayette County courtroom this morning at 9:00 a.m.
