In a number of states, local land use controls is being taken away by state legislators in an effort to promote renewable energy production. Most communities have ordinances that restrict, or prevent landowners from installing small scale devices like wind turbines or solar panels. University of Missouri Associate Law Professor Troy Rule says while the intention of states is noble, having the state dictate to communities what they can allow is the wrong way to go.
Rule says if states want to encourage that type of development, there is a better way to go about it.
Right now, Rule says there is no effort underway in the Missouri Legislature to enact similar laws to take away local land use controls from local governments or community associations.
