MILLER COUNTY, MO – An appeals court in Missouri overturned a conviction of involuntary manslaughter Tuesday against a woman charged in the death of a newborn baby.

According to the Columbia Daily Tribune, the Western Missouri Appeals Court ruled that Emily Usnick, 43, of Miller County did not act recklessly or criminally when she wrapped the baby in a plastic bag after the unattended birth, and did not seek medical attention. The body was discovered in the trunk of a derelict car by law enforcement after a search warrant at Usnick’s home for drugs. Usnick’s official statement, during a Johnson County trial, was that the birth was stillborn.

The court ruled Tuesday, the official cause of death could not be determined by the court.
