A December first bench trial is scheduled for a man whose guilty plea in a Howard County murder case was vacated. According to reports, 26-year-old Charles O’Neal pleaded guilty in 2008 to second degree murder, armed criminal action and first degree assault. A judge last summer upheld O’Neal’s motion which claimed his attorneys gave him faulty advice leading up to his guilty plea. The charges have since been upgraded to first degree murder, two counts of armed criminal action and first degree assault. O’Neal’s trial will be at the Randolph County Justice Center in Huntsville.
