Tort reform is moving forward in the Missouri Senate.
The sponsor of SB 591, Bill White, indicates the seeking of punitive damages in a case should be rare, and used only in cases in which the claimant proves intentional or flagrant harm. White’s bill says, only intent or flagrant disregard for safety should be factors under which punitive damages may be sought.
Punitive damages should only be intended for the purpose of dissuading the defendant from future acts, and should not intended to be compensatory toward the victim.
