A pre-trial conference was scheduled to be held Wednesday afternoon for an Independence resident charged in the shooting death of his brother. David Womack, 48, allegedly killed Bill Womack, 58, outside their mother’s home in Carrollton in early January 2011. David has been charged with murder and armed criminal action. His case was moved to Ray County, but he did not show for his court hearing Wednesday. No reason was given as to why Womack failed to appear. At this time, he is scheduled to go on trial in mid-December.
A Carrollton man scheduled to go on trial in February was expected to return to a Ray County courtroom Wednesday, but he too was a “no show.” No reason was given in that case either. According to online court documents, the case against Mark Rhodes, 46, had been prepared to go to trial in July of this year, but a judge granted the defense’s motion for a continuance. Rhodes faces one count each of first degree murder and armed criminal action for allegedly killing his ex-wife, Tina Rhodes, 44, in September 2010. Legal teams reset the trial during a hearing this summer. The case is being tried in Ray County on a change of venue.
