KIRKSVILLE, Mo. — Assault is one of three felony charges listed against a Novinger man in Adair County.

According to a probable cause statement, law enforcement was dispatched to an address in Novinger for a shooting on Monday. The shooting victim alleges  Richard L. McCully, Jr., 37, drove up to him and fired a round through his vehicles windshield.

McCully told police he shot because the victim tried running him over. Surveillance video allegedly shows McCully drive alongside the victim while pumping gas and opened fire.

McCully is formally charged with assault in the first degree, armed criminal action, and unlawful use of a weapon.

McCully is currently out of custody awaiting a court date.
