HENRY COUNTY, Mo.- The Henry County Prosecuting Attorney’s Office has filed formal charges against a Clinton, Mo., man on allegations of sexual assault dating back to July of 2011.
Court documents indicate Benjamin Busick, 31, of Clinton, Mo., was charged yesterday, January 2, 2018, with one count of felony forcible rape-sexual intercourse by forcible compulsion.
The charges stem from an incident back in July of 2011, at the Safari Motel in Clinton. According to a probable cause statement, on September 22, 2017, the victim filed a report with a detective of the Clinton Police Department.
Per the victim’s statement, in July of 2011, the two were at the Safari Motel where they consumed alcohol. The victim reported passing out, at which time fully clothed, and that when upon waking up, pants and underwear had been removed. Busick reportedly forced himself upon the victim sexually while the victim continued to tell him to stop.
The range of punishment for the unclassified felony of forcible rape is imprisonment in the custody of the Missouri Department of Corrections for life or for a term of years no less than five years.
A judge was assigned to the case yesterday and future court dates are currently pending. It remains unclear weather Busick is in custody at this time. A bond has yet to been set.
