BUCHANAN COUNTY, Mo. – Five defendants related to the May shooting death of Skylar Powell in St. Joseph, have trial settings at 2:00 in Buchanan County today.
Justin D. Smith, 20, of Agency, is charged with voluntary manslaughter and armed criminal action in the shooting of Powell. Ashten H. Surritte, 19, of Smithville, is charged with attempted first degree robbery by conspiring with Powell to rob Dayne Mathews and providing Powell with a gun. Gabriel K. Dawson, 17, of St. Joseph is charged with attempted first degree robbery for planning with Justin Smith to rob Skylar Powell. Kyle W. Smith, 25, of St. Joseph is charged with possession of a controlled substance with intent to distribute and tampering with physical evidence of a felony for providing marijuana to Justin Smith for resale and disposing of the weapon used to shoot Powell. Dayne A. Matthews, 19, of St. Joseph is also charged with conspiring to distribute a controlled substance by obtaining marijuana to sell to Skylar Powell and conspiring to dispose of the weapon used in the shooting.
All the defendants have pleaded not guilty to each allegation.
