charges filed

Dayne Alexander Matthews, 19, of St. Joseph, Justin D. Smith, 20, of Agency, Ashten Haylee Surritte, 19, and Kyle W. Smith, 25, have been charged in connection with Powell’s death.

A 16-year-old has also been charged; however the suspect’s name and photo will not be released at this time.

According to probable cause statements, Surritte conspired with Powell to rob Matthews and Justin Smith of a quarter pound of marijuana. Surritte supplied Powell with Matthews’ phone number and picture.

According to the Buchanan County prosecuting attorney, Smith and Matthews attempted to sell the marijuana to Powell when the 16-year-old and Powell reportedly attempted to rob the two. Kyle then later took possession of the semiautomatic used in the shooting and disposed of the weapon in order to prevent the discovery of that weapon by law enforcement, obstructing the prosecution of Justin Smith.

He is scheduled to appear in court June 27, 2016, at 3 p.m. in St. Joseph for a Preliminary Hearing. Court records indicate Matthews posted a full cash bond of $24,000.
